The Legality of Online Gambling

Online gambling is an expanding phenomenon that is growing in popularity. It includes a number of different types of activities such as virtual poker, sports betting, casinos, lottery games, and lotteries. These online forms of gambling have become widely available and offer numerous bonuses and promotions.

There have been several questions raised regarding the legality of online gambling, including how best to protect consumers and the state’s ability to regulate the industry. The legality of the Internet and its role in gambling is also being scrutinized by federal authorities. In particular, the United States Department of Justice is considering whether to prosecute operators of illegal Internet gambling sites.

First, there is the legal question of whether the federal government has the jurisdiction to enforce state gambling laws. The issue is further complicated by the dormant Commerce Clause doctrine, which theorizes that the power to enforce federal laws belongs to the federal government. While Congress has used the power of the Commerce Clause to control the size and scope of state and tribal land-based gambling enterprises, it has not been able to block states from enforcing their own local laws.

A similar question was answered by the 10th Circuit Court of Appeals in the case of United States v. Heacock. This case dealt with the legality of betting on a sporting event. While the Supreme Court held that the act of entering a bet is a legitimate gambling activity, it questioned the constitutionality of the State of New York’s law requiring a minimum age of 21.

Second, there is the UIGEA, or the Unlawful Internet Gambling Enforcement Act. The UIGEA contains several important factors that will help to weed out low-level gambling cases. However, the UIGEA does not prohibit internet gambling businesses from taking bets from the United States.

Finally, there is the Wire Act, which is a federal statute aimed at prohibiting illegal gambling on sporting events. Although the Wire Act is not the most comprehensive legal measure, it does serve as a useful tool to combat the criminal enterprise. The Act carries with it a number of fines and penalties, but is unlikely to deter much online gaming.

The Travel Act also has a role to play. In addition to requiring that gambling on interstate facilities be legal, the statute imposes a penalty on players who use such facilities for unlawful activities.

On the state level, Ohio has moved quickly to offer more robust online gaming options. Governor Mike DeWine has signed into law House Bill 29, which gives the Ohio Casino Control Commission authority to license and regulate operators of online gambling sites. Over the summer, the Commission accepted applications from businesses interested in operating online wagering sites.

Although no online gambling sites are currently available in Ohio, the state is working on launching its first online sports betting site by the end of the year. The launch of the new online sport is a significant milestone and will be a test for whether further online gambling in the Buckeye State will be legalized.
