The legality of Internet gambling has been challenged on many grounds. The Commerce Clause, First Amendment guarantee of free speech, and Due Process Clause have all been challenged. However, these challenges have not been successful, as the commercial nature of gambling seems to satisfy Commerce Clause concerns. Free speech objections are also limited, and due process arguments suffer because the gambling activity is conducted in the United States.

Legitimate online casinos have licenses and are subject to government regulation. They should also display their license information on their websites. However, it’s important to be wary of scams and fraudulent operators. Online gambling is illegal in some countries, and accessing an online casino can be a crime. Age restrictions apply to every country, so you must be at least 18 years of age to gamble. If you’re underage, it’s illegal to gamble.

Illegal Internet gambling violates federal criminal statutes. A recent case reported by the American Banker revealed that several Internet poker operators had engaged in illegal gambling and agreed to pay a fine of $4 million and launch a $3 million public service campaign. These cases highlight the potential for a wide variety of crimes, and show that the legality of online gambling has been challenged on many levels.

Illegal Internet gambling implicates seven federal criminal statutes. These include the Wire Act and the Illegal Gambling Business Act. The Wire Act prohibits the use of the internet to wager on contests or sporting events. The Travel Act and Racketeer Influenced and Corrupt Organizations Act also prohibit certain gambling activities on the Internet.
